In case of conflict between translations, the Portuguese version prevails.
1. Service Provider & Nature of Service
MyClub is operated by FABWIND LDA, Portugal (NIF: PT516581716) (“Provider,” “we,” “us”). MyClub is a technology platform only — a digital tool that enables users to coordinate cycling activities, record GPS data, and share content within private groups. We do not organise, supervise, lead, sponsor, or conduct any ride, route, event, challenge, or athletic activity. All rides, routes, segments, and group activities are created entirely by users. The Provider is not a sports organiser, event company, tour operator, or cycling club. We have no control over when, where, or how users ride.
2. User-Generated Content & Routes
All content on MyClub — including rides, routes, segments, leaderboards, photos, and group descriptions — is created by users, not by the Provider. We do not verify, inspect, approve, endorse, or guarantee the safety, legality, accuracy, or suitability of any user-generated route, segment, or ride proposal. A route appearing in MyClub does not mean it has been checked for road conditions, traffic, hazards, closures, legal restrictions, or surface quality. Users who propose rides or create routes are solely responsible for their content and for communicating relevant risks to participants.
3. Assumption of Risk & Release of Liability
YOU EXPRESSLY ACKNOWLEDGE THAT CYCLING AND OTHER ATHLETIC ACTIVITIES CARRY INHERENT AND SIGNIFICANT RISKS OF PROPERTY DAMAGE, BODILY INJURY, OR DEATH.
These risks include but are not limited to: traffic collisions, falls, equipment failure, adverse weather, road hazards, physical exertion, and the actions or inaction of other riders or third parties.
BY USING MYCLUB, YOU VOLUNTARILY ASSUME ALL KNOWN AND UNKNOWN RISKS ASSOCIATED WITH YOUR ATHLETIC ACTIVITIES, including risks arising from routes, segments, or challenges created by other users, even if caused in whole or in part by the action, inaction, or negligence of the Provider or others.
You expressly agree that the Provider does not assume responsibility for the inspection, supervision, preparation, or conduct of any ride, challenge, segment, or group activity that uses the platform, including any organised by a group administrator or ride proposer. To the maximum extent permitted by applicable law, you agree to release the Provider, its affiliates, officers, agents, and employees from any and all liability in connection with your athletic activities and use of the platform.
4. Platform Disclaimer — What MyClub Is NOT
MyClub is NOT:
- (a) An emergency service or safety device — the SOS button and crash detection notification are peer-to-peer communication aids only that attempt to relay information between club members. They do NOT contact emergency services (112, 911, or any equivalent). They do NOT guarantee delivery or response. ALWAYS CALL 112 OR 911 DIRECTLY IF YOU NEED EMERGENCY ASSISTANCE.
- (b) A navigation system — routes are informational and not guaranteed to be safe, legal, passable, or accurate. Route calculations, surface classifications, and turn-by-turn guidance generated by the Platform’s routing tools are based on third-party mapping data and algorithmic estimates. They are not verified for accuracy or safety and are provided for informational purposes only. Always verify conditions independently.
- (c) A medical device or safety monitoring system — no feature in MyClub, including crash detection, is designed, tested, certified, or intended as a medical device, personal safety device, or emergency response system under any regulatory framework. Crash detection uses consumer-grade phone sensors (accelerometer, gyroscope) that provide approximate estimates only.
- (d) A real-time tracking guarantee — GPS positions are approximate (typically ±10–50 metres), subject to signal quality, battery, and network conditions. The family tracking feature is a convenience tool, not a safety guarantee.
- (e) A device sync guarantee — route delivery to Garmin, Wahoo, or other devices depends on third-party APIs and Bluetooth connectivity, which may fail without notice.
5. Safety Communication Features — SOS & Crash Detection Notification
MyClub includes features designed to help club members communicate during rides. These features aim to speed up awareness among your riding companions when something may have gone wrong. They are community communication aids between users — nothing more.
5.1 SOS Alert
The SOS button allows you to send an alert with your approximate GPS location to members of your clubs via push notification. SOS alerts may be triggered manually by pressing the SOS button, or automatically by the crash detection system described in Section 5.2. In both cases, the alert is a best-effort communication aid between club members — it is not a guaranteed emergency notification.
5.2 Crash Detection Notification
MyClub may use your phone’s built-in sensors (accelerometer, gyroscope, GPS) to detect patterns consistent with a potential cycling incident — such as a sudden deceleration followed by a period of no movement. If a potential incident is detected, the app initiates a 60-second countdown during which you can cancel the alert. If you do not respond within 60 seconds, the app sends a notification with your approximate GPS location to your designated emergency contacts and the Captain (group administrator) of every club you belong to.
What crash detection notification does:
- Attempts to notify your club members (fellow riders, friends) that you may need assistance.
- Provides your approximate GPS location to help them find you.
- Aims to reduce the time between a potential incident and your companions becoming aware.
What crash detection notification does NOT do:
- It does NOT contact police, ambulance, fire services, or any emergency service.
- It does NOT guarantee that an incident will be detected.
- It does NOT guarantee that a notification will be delivered successfully.
- It does NOT prevent, mitigate, or respond to any crash, fall, or injury.
- It does NOT provide medical assessment, triage, or diagnosis of any kind.
- It does NOT replace calling 112 or 911, wearing a helmet, carrying identification, or any other personal safety measure.
- It is NOT a substitute for riding with companions, informing others of your route, or any other established cycling safety practice.
5.3 Technical Limitations & Known Risks
Both the SOS button and crash detection notification are subject to the following limitations:
- False positives: Crash detection may trigger from non-incident events such as dropping your phone, hitting a pothole, sudden braking, dismounting quickly, or placing your phone on a hard surface. You will have a countdown window to cancel false alerts.
- False negatives: Crash detection may fail to detect an actual incident. Detection depends on sensor accuracy, phone placement, ride speed, crash dynamics, terrain, and numerous factors beyond our control. You must never rely on this feature as your sole or primary safety measure.
- Network connectivity: Alerts require cellular data or WiFi. Rural and mountainous areas — common cycling terrain — may have no coverage. Alerts cannot be sent without a network connection.
- GPS accuracy: Location provided is approximate (±10–50 metres or more), may be delayed, or unavailable due to signal loss, terrain, tree cover, tunnels, or atmospheric conditions.
- Delivery failures: Push notifications may be delayed, blocked by device settings, battery optimisation, OS restrictions (including Android Doze, iOS Background App Refresh), or Firebase service interruptions.
- Recipient availability: Club members may not see alerts immediately, may have notifications disabled, may be riding themselves and unable to check their phone safely, or may not be in a position to respond or assist.
- Battery and device state: Low battery, power-saving modes, or OEM battery optimisation (Samsung, Xiaomi, Huawei, and other manufacturers) may prevent the app from functioning, detecting incidents, or sending alerts.
- Phone placement: Detection accuracy varies significantly depending on whether the phone is in a jersey pocket, mounted on handlebars, in a saddlebag, or carried elsewhere on your person or bicycle.
5.4 Your Responsibilities
- ALWAYS call 112 or 911 directly if you need emergency assistance. This is always the fastest and most reliable way to get help.
- You must not rely solely on MyClub for emergency communication under any circumstances.
- You acknowledge that club members receiving alerts are not trained emergency responders and may not be qualified, available, or able to assist you.
- You must carry a charged phone with active cellular service if you wish to use these features.
- You are responsible for maintaining your own safety equipment, including a helmet, identification, and a means of contacting emergency services directly.
- You are responsible for ensuring that the crash detection and SOS features are appropriately configured in the app settings.
5.5 No Liability for Safety Feature Outcomes
THE PROVIDER IS NOT LIABLE FOR:
- Delayed, failed, or inaccurate delivery of SOS or crash detection alerts;
- Failure to detect an actual incident (false negative);
- False detection of a non-incident (false positive) and any consequences thereof;
- Inaccurate GPS locations provided in alerts;
- Actions, decisions, response times, or inaction of club members who receive alerts;
- Injury, death, or property damage occurring before, during, or after an alert is sent or received;
- Any outcome resulting from reliance on, or failure to rely on, these features;
- Any technical failure, service interruption, or limitation described in Section 5.3;
- Any claim that earlier notification would have changed the outcome of an incident.
BY USING THE SOS OR CRASH DETECTION FEATURES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE LIMITATIONS AND VOLUNTARILY ACCEPT ALL RISKS ASSOCIATED WITH THEIR USE. THESE FEATURES ARE PROVIDED AS A BEST-EFFORT COMMUNITY COMMUNICATION AID AND NOT AS A SAFETY GUARANTEE OF ANY KIND.
6. Ride Proposer Responsibilities
Any user may propose a ride. The rider who proposes a ride (“Ride Proposer”) is solely responsible for: selecting an appropriate route; assessing and communicating risks or known hazards to participants; ensuring compliance with applicable traffic laws and local regulations.
The Ride Proposer is NOT an agent, employee, contractor, or representative of the Provider. The Provider has no obligation to verify, approve, or supervise any proposed ride, route, or segment. Participation in any ride is voluntary and at each individual rider’s own risk.
7. Segments & Leaderboards
Segments and leaderboards are informational features that record timing data. They are NOT races, competitions, or organised events. The Provider does not encourage users to exceed speed limits, ignore traffic laws, or take risks to achieve faster segment times. Users are solely responsible for riding safely and legally at all times, regardless of segment rankings or leaderboard positions. The Provider is not liable for any injury, damage, or death arising from a user’s attempt to achieve a faster segment time.
7.1 Activity Data Ingestion
When a user connects Garmin or Wahoo and grants consent, MyClub processes their activity GPS data to build route suggestions for the group. The polyline is anonymised before storage — the first and last 200 metres are trimmed and timestamps are stripped. The anonymised route shape is retained as part of the group’s route intelligence. This processing requires explicit opt-in consent (separate from connecting the device). Consent can be withdrawn at any time from settings, which stops future processing and deletes contributed route shapes and compact GPS tracks. The user’s identifier is also scrubbed from other members’ track metadata (rider counts, usage logs). Account deletion performs a full delete of all data.
7.2 Segment Leaderboard Attribution
When a user grants leaderboard consent, their activity data is matched against group segments to update group leaderboards. A compact timestamped GPS track (latitude, longitude, timestamp — no heart rate or power) is retained for up to 12 months to allow retroactive matching when group captains create new segments. This is separate from the anonymised route shape. Withdrawal of leaderboard consent stops future attribution and anonymises historical efforts — the display name is replaced with “Former Member” and profile images are removed. Personal-best leaderboard entries are deleted. Account deletion fully removes all effort records.
7.3 Surface Classification
Route shapes are automatically classified by surface type using OpenStreetMap data. A subset of GPS coordinates from each activity are sent to OpenStreetMap’s Overpass API to determine road surface characteristics (paved, gravel, unpaved). No personal data is sent — only geographic coordinates. The resulting surface classification is stored with the anonymised route shape.
8. Group Administration
Users who create or administer groups (“Group Admins”) are solely responsible for their group’s conduct. Group Admins are NOT agents, employees, or representatives of the Provider. The Provider does not supervise, endorse, or control any group’s activities, membership decisions, or internal rules.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: personal injury, death, property damage, loss of data, loss of profits, or emotional distress arising from or related to:
- (a) your use or inability to use the platform;
- (b) any route, segment, ride, or activity created by users;
- (c) GPS accuracy, signal loss, or tracking failures;
- (d) SOS or crash detection notification failures, including false positives and false negatives;
- (e) third-party service interruptions (Garmin, Wahoo, Strava, Google Maps, Firebase, or other providers);
- (f) actions or inaction of other users, ride proposers, group administrators, or alert recipients;
- (g) device sync failures or data loss;
- (h) any claim that a safety communication feature should have performed differently.
THE PROVIDER’S MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (a) FIFTY EUROS (€50) OR (b) THE TOTAL FEES PAID BY YOU TO THE PROVIDER IN THE 12 MONTHS PRECEDING THE CLAIM.
If you are a consumer residing in the European Union, nothing in these terms limits your statutory rights under applicable EU consumer protection law, including rights related to the Provider’s negligence or breach of legal obligations.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Provider from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the platform; (b) your athletic activities; (c) routes, segments, or content you create; (d) your violation of these terms or applicable law; (e) your violation of any third party's rights.
11. Third-Party Services
MyClub integrates with third-party services including Garmin Connect, Wahoo Cloud, Strava, Google Maps, Mapbox, and Firebase. These services are governed by their own terms of service and privacy policies. The Provider is not responsible for the availability, accuracy, or functionality of any third-party service. Third-party API access may be modified or discontinued at any time without notice to us or you.
12. Acceptable Use
You agree not to: create segments on roads where cycling is prohibited or dangerous; harass, threaten, or endanger other users; use the platform for any illegal purpose; attempt to reverse-engineer, copy, or exploit the platform; upload false, misleading, or harmful content; impersonate another person or entity.
13. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE PROVIDER DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED SERVICE.
We do not warrant that the platform will be error-free, secure, or available at all times. We do not warrant that any safety communication feature will detect all incidents, deliver all notifications, or function under all conditions.
14. Modifications
We may update these terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via the app or email with reasonable notice.
15. Termination
We may suspend or terminate your account for violation of these terms. You may delete your account at any time. Sections 3, 5.5, 7, 9, 10, 13, and 20 survive termination.
16. Governing Law & Jurisdiction
These terms are governed by Portuguese law. Disputes shall be submitted to the courts of Viseu, Portugal. EU consumer rights, including the right to use your local courts, are fully preserved. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable EU law.
17. Premium Subscriptions
MyClub offers an optional Premium subscription (“MyClub Premium”) with enhanced features. By subscribing, you agree to the following:
- Pricing: Monthly (€5.99/month) or Annual (€39.99/year). Prices may change with 30 days’ notice.
- Free trial: New accounts automatically receive a 30-day free trial upon completing setup. No payment method is required. Each user is entitled to one free trial only.
- Billing: Payments are processed by Stripe, Inc. Subscriptions auto-renew at the end of each billing period unless cancelled.
- Cancellation: You may cancel at any time from the app settings or by contacting us. Cancellation takes effect at the end of the current paid period — no partial refunds are issued for unused time.
- Refunds: Refund requests are handled in accordance with applicable EU consumer protection law. For voluntary cancellations after the 14-day cooling-off period, no refunds are provided.
- Feature access: Premium features are personal to the subscriber. If your subscription ends, you return to the free tier. Content you created (routes, segments) remains available to your groups.
- Group creation: Free users may create 1 group. Premium users may create unlimited groups. The 1-group limit applies even during the free trial period.
18. Advertising
Free users may see non-personalised advertisements within the app. Advertisements are never displayed during active ride recording, over safety features, or on payment screens. Premium subscribers receive an ad-free experience. The Provider reserves the right to modify ad placement and frequency at any time.
19. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
20. RideReel — Video Content & Footage Licensing
20.1 What is RideReel
RideReel is a feature that allows users to record and broadcast video footage of cycling segments during rides using action cameras (GoPro, DJI, Insta360) or phone cameras. Recorded clips may be retained by the Provider to build a crowdsourced cycling video library for segment previews, route guides, and promotional content.
20.2 Consent & License Grant
When you enable RideReel, you are asked to accept a per-session consent confirming that your footage may be used for segment previews and route guides. This consent is remembered across sessions but may be revoked at any time in Settings.
By accepting the RideReel consent, you grant the Provider a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to: store, process, transcode, compress, and distribute your footage; display your footage as segment previews, route guide clips, and promotional content within the Platform and on the website (myclubride.com); sublicense your footage to tourism boards, cycling brands, and other commercial partners for the purpose of route promotion and cycling tourism.
This license does NOT transfer ownership of your footage. You retain all intellectual property rights to your original recordings.
20.3 Clip Curation & Featured Content
Clips are automatically scored based on completeness, video stability, resolution, lighting conditions, and recency. The highest-scoring clip for each segment may become the featured preview visible to all users. The Provider reserves the right to remove, replace, or demote any clip at its sole discretion.
20.4 Revocation & Deletion
You may revoke the RideReel consent at any time in the app’s Settings. Upon revocation: (a) no new footage will be recorded or broadcast; (b) you may request deletion of your existing clips by contacting info@myclubride.com; (c) we will remove your clips from the active library within 30 days of receiving a valid deletion request. Previously sublicensed content may persist with commercial partners for up to 12 months after deletion from the Platform.
20.5 Third-Party Content in Footage
You are solely responsible for ensuring that your footage does not infringe the rights of third parties (including but not limited to: other riders, bystanders, private property owners, copyrighted works). Do NOT deliberately film identifiable individuals without their consent. The Provider may remove footage that violates third-party rights upon notification.
20.6 Technical Limitations
RideReel depends on: a stable cellular or WiFi connection for live broadcast; compatible action camera or phone camera; sufficient device battery; GPS signal for segment detection. The Provider does not guarantee: stream quality, availability, or uninterrupted recording; successful clip upload or archival; detection of all segment entries or exits. Video recording and broadcasting are secondary to GPS ride tracking. If broadcasting fails, your ride recording is not affected.
20.7 Commercial Use
The Provider may use curated RideReel footage for commercial purposes including but not limited to: tourism board partnerships; cycling brand challenges and sponsored content; premium route guides with video previews; embedded video on the website and social media. Revenue generated from commercial licensing of curated footage is retained by the Provider. Users do not receive royalties or compensation for footage used commercially, as agreed in the license grant in Section 20.2.
20.8 Content Moderation & Automated Screening
All RideReel clips are subject to automated and manual content moderation before being made publicly visible. Clips enter a quarantine period (up to 24 hours) during which automated checks are performed. The Provider employs the following moderation layers:
- GPS correlation — clips must originate from a verified ride session at a known segment location. Footage without matching GPS data is automatically rejected.
- Metadata validation — clips must meet minimum duration (5 seconds), maximum duration (10 minutes), valid resolution, and correct aspect ratio. Clips exceeding these bounds are rejected.
- Community reporting — users may flag clips as inappropriate. Clips receiving 3 or more independent flags are automatically hidden pending admin review.
- Admin review — the Provider reserves the right to review, hide, or permanently remove any clip at its sole discretion, without prior notice.
Users who repeatedly upload content that fails moderation checks may have their RideReel privileges suspended or their account terminated under Section 14. Attempting to circumvent moderation systems (e.g., uploading manipulated metadata, spoofed GPS data, or disguised content) constitutes a material breach of these Terms.
